Child abandonment?
Q. My niece is three years old and resides with her grandmother. Her mother and father are drug addicts and do not see her but maybe once every couple of months. My mother in law will not do anything about the situation. Is this considered child abandonment when the parents leave their child with her for six months and do not make an effort to see her? My mother in law is trying to protect her daughter and hopes that she will clean up her act. It has been over two years that this has been going on. I have called CPS and they stated that becuase the child is in a safe place away from the parents there is nothing that can be done. I do not feel that the grandmother is a fit parent either. Both my husband and his sister the drug addict… [cont.]

A. Yes it is child abandoment..But at least she's with the grandmother. I don't think she should be with her parents for her safety if they're sick right now off of drugs. They need to receive treatment first before trying to care for that little girl. The grandmother is doing what she think is best. Her parents can't take care of themselves right now, let alone a small child. Maybe you should try to help the grandmother with your niece, to make the load easier on her. Well considering the additional comments..I think that you really know in your heart what's best for your niece. I only know a fragment of info. but you know the whole story. Child Abandonment?
Q. I live in Oklahoma and was needing so advice on how child abandonment work. how do i apply and what are the nessacery things that have to be going on in order for the abandonment to take place. OK so i guess i need to go into further detail. The father of my child hasn't payed any child support in a long time, nor has he tried to see his son. I heard that you can file for child abandonment and he can lose his rights. The reason I want to do this is so it doesn't become a problem with custody in the futre. just wanting to know what to do. A. Child Abandonment is a crime that is committed when a child fails to properly care for a child by abandoning them. If your parents have abandoned you, contact the police. If you are talking about emancipation, that is a different thing all together.

Q. A 5-year-old child is left alone at table in the mall for 5 or 6 hours. A. It depends a lot on where she is coming from and where she is going. In some (most) states, 18 is the minimum before a child can relocate without parental consent. It would not be a matter of abandonment, btw, if her state does not allow it, you would be technically guilty of kidnapping across state lines. If her parents agree, they can grant you custody (assuming you are over 18), which will resolve the issue. Also understand that you need to make arrangements for schooling, medical care, etc, which will not be possible without parental consent.

Q. I have an 20 month old son and we live in michigan but his biological father lives in Texas and has never one seen him or even called to ask about him other then his mother emailing me. Now all of the sudden he wants to come into his life and I am not sure I want this. He does pay child support but not very regularly. A. He can only get her for child abandonment typically if she disappears and does not see or speak to or send ANY mail to her daughter for 2 years. At that time, he can file for full custody and if his ex decides to come back to try to be in her daughter's life after 2 years she will have no rights. However, for her rights to be legally stripped from her she must either sign over her parental rights or not see/contact/send anything to her daughter for the next 2 years. Either that, or he can go to court any time to sue for full custody. If she really is not around that often, he will most likely be granted full custody. Good luck.

A. It varies from state to state... But in my state, you have to have had no contact with the child for at least 6 months, then the mother (in your case) would have to place an "ad" in the paper for a month stating that she's filing for abandonment and give you the chance to contact her and/or the courts. Then it goes to court. Wait until the court date, tell your case to the judge and the judge will most likely grant you visitation. They won't terminate your rights if you are truly trying to have a relationship with your child.

A. I think with infants, it is pretty much a guessing game.They have to "guesstimate" their age and usually the hospital will give them a name. In the case of abandonment, if the parent comes forward, they may be able to have contact once the parent proves that they have received counseling or something .

A. First of all, I hope you sought court authorization prior to moving to Louisiana. If not, you could have a major problem if you decide to take your ex back to court. Read your court order carefully. If there is anything in it stating that the court "retains jurisdiction," you will have to hold all future court proceedings with the court in Georgia. If not, wait until you've been in Louisiana for one year and try your luck. Chances are your ex won't show up and you will get a default judgment. Once that's done, have child support enforcement track him down. Be sure you had court authorization to take your child out of state. If not, your ex can claim he didn't pay support or see the child because he didn't know where you were.

NO, because she has not legally abandoned her she placed her with someone she trusted to care for her and that is all that is required under Oklahoma law, if the sister does not want to care for the child any longer perhaps she would allow you and the child's father to step in until the mother returns, once a child enters protective services it can sometimes be very difficult to get them back.~
